(“VMI”) and its brands (collectively, “VMI Brands”). By accessing and using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please discontinue using the App.
1. Definitions and Interpretation
1.1 App means the software application known as Creators Connect provided by VMI for use by customers.
1.2 Services include offers, deals, service bookings, rewards memberships, and promotions provided by VMI Brands through the App.
1.3 You or User refers to the person using the App, whether as a registered or unregistered user.
2. Access to and Use of the App
2.1 Age Requirement: You must be at least 18 years of age or over the applicable age of majority in your jurisdiction to use the App. If you are under 18 years old, you may only use the App with the consent and involvement of your parent or guardian.
2.2 Security Credentials: Access to certain features of the App may require you to register and create an account with security credentials (such as a username and password). You are responsible for maintaining the confidentiality of your account and credentials, and you agree to notify us immediately if you suspect any unauthorized access or use of your account.
2.3 Use of the App: The App allows users to browse and benefit from offers, deals, and services provided by VMI Brands. You agree to use the App only for lawful purposes and in accordance with these Terms.
2.4 Third-Party Services: VMI Brands may use third-party service providers to facilitate the booking of services or the fulfillment of offers. You acknowledge that VMI is not responsible for the quality or delivery of services provided by third parties.
3. Offers, Deals, and Rewards Memberships
3.1 Offers and Deals: VMI Brands may from time to time offer promotions, discounts, and other deals through the App. These offers are subject to specific terms and conditions, which will be made available in conjunction with the respective promotion.
3.2 Service Bookings: Users may book services provided by VMI Brands through the App. Availability, pricing, and fulfillment of such bookings are subject to the policies of the respective VMI Brand.
3.3 Rewards Membership: Users may enroll in rewards programs offered by VMI Brands through the App. Participation in any rewards membership will be governed by separate program guidelines specific to each VMI Brand.
3.4 Modification of Offers: VMI Brands reserve the right to modify, suspend, or discontinue any offers, deals, or rewards programs at any time without prior notice.
4. Termination or Suspension of Access
4.1 Termination by Us: VMI may terminate or suspend your access to the App at any time, without prior notice, if you breach these Terms or if VMI deems it necessary to do so for security reasons.
4.2 Termination by You: You may terminate your use of the App at any time by ceasing access and deleting the App from your device.
4.3 Effect of Termination: Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.
5. Intellectual Property
5.1 Ownership: All intellectual property rights in the App and the content provided through it, including but not limited to trademarks, logos, and designs, are owned by VMI or its licensors. You are granted a limited, non-transferable license to use the App solely for personal, non-commercial purposes.
5.2 Restricted Use: You may not modify, reproduce, distribute, or create derivative works of any content from the App without prior written permission from VMI or the respective rights holders. You may not attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of the App.
6. Disclaimers and Limitations of Liability
6.1 App Availability: The App is provided “as is” and “as available.” VMI does not guarantee that the App will be available at all times or that it will be error-free.
6.2 Accuracy of Information: While we strive to ensure the accuracy of information provided through the App, VMI does not warrant the accuracy, completeness, or reliability of any content or offers displayed in the App.
6.3 Limitation of Liability: To the maximum extent permitted by law, VMI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
7. Privacy
7.1 Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.
8. Changes to Terms
8.1 VMI reserves the right to modify these Terms at any time. We will notify users of any material changes via the App or through the email address associated with their account. Continued use of the App following such modifications constitutes acceptance of the updated Terms.
9. Governing Law and Jurisdiction
9.1 These Terms shall be governed by and construed in accordance with the laws of Singapore. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
10. General Provisions
10.1 Entire Agreement: These Terms constitute the entire agreement between you and VMI regarding your use of the App.
10.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10.3 No Waiver: The failure of VMI to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
